| Article 115. Availability of evidence: Except for cases provided by law, the judge must decide relying on the proves proffered by the parties or by the public minister and the facts that were not specifically contested from the standing party. S/he may, in any case, without need for evidence, place notions of fact that are part of common knowledge at the foundation of the decision. | Articolo 115. Disponibilità delle prove: Salvi i casi previsti dalla legge, il giudice deve porre a fondamento della decisione le prove proposte dalle parti o dal pubblico ministero nonché i fatti non specificatamente contestati dalla parte costituita. Il giudice può tuttavia, senza bisogno di prova, porre a fondamento della decisione le nozioni di fatto che rientrano nella comune esperienza. |
| Article 116. Evaluation of evidence: The judge must evaluate the evidence according to his/her prudent judgment, unless the law otherwise provides. The judge may deduce arguments of proof from the answers that the parties give him/her according to the following article, from their unjustified refusal to consent to inspections that s/he ordered and, in general, from the behavior of the parties themselves in the trial. | Articolo 116.
